In accordance with the Legal and Procedural Issues Commission of Batumi City Council the attendance of the Chairman of Health and Social Affairs Commission –Dimitri Darchia on the city council session was not illegal for the following reasons:
The Chairman of the Health and Social Affairs Commission of Batumi City Council- Dimitri Darchia has been given his scheduled leave on March 1, as a council official (as the chairman of the commission).
Herewith while being on his vacation the city council member’s authority shall not be suspended. To attend the city council meetings and to take part in voting process is absolute right.
According to the “Local Self-government Code”, article 43, paragraph 6, the authority of the city council member shall be suspended only if the court sentences imprisonment or if there is administrative detention on administrative case. As a result while being on vacation or temporarily disabled the authority of the city council member shall not be suspended.
