Today, member of Batumi City Council’s faction “National Movement” Nodar Dumbadze held briefing in the meeting hall of City Council. By the said of  Nodar Dumbadze, at the meeting of Batumi City Council held on 16th of March with 13 voices (minimal number of voice, that is necessary for the changes in the budget) received resolution, there were made changes in the budget of Batumi, according to which allocated funds from Batumi budget to Batumi “Dinamo” should be transferred to N(N)LE “Football Development Fund”.  
By the said of Nodar Dumbadze, from 13 voices, one voice belonged to the chairman of Health and Social Issue Commission-Dimitri Darchia, who at that moment was on leave of absence. Nodar Dumbadze considers that according to the acting legislation, Dimitri Darchia had no right to participate in the voting. Accordingly, City Council was not able to receive decision and resolution signed by Irakli Tcheishvili is illegal.  Nodar Dumbadze called Mayor of the city, not to transfer money as in the nearest future, faction plans to ask Batumi Civic Court for invalidation of this resolution. Chairman of Health Defense and Social Issue Commission of City Council-Dimitri Darchia said that accusations of Nodar Dumbadze are groundless.
Dimitri Darchia declared that on 1st of March of the current year, he was really given his owned leave as the official of City Council –Chairman of the Commission: “I as a member of City council during my leave, was not suspended authority of being member of City Council and my unlimited right is to attend meetings of City Council and to participate in the process of voting.

By the declaration of the Chairman of Juridical and Procedure Issues Commission of City Council-Levan Kintsurashvili, member of City Council will be stopped authority only in one case, that is administrative imprisonment on administrative issues. Legislation doesn’t foresee other basis for suspension of the authority. Besides this, according to the Georgian Law about “Public Service”, regulatory norms on suspension of the authority during the leave is not spread on the members of City Council. By the said of Levan Kintsurashvili, Dimitri Darchia didn’t broke the law and his participation in the process of meeting was absolutely legitimate.
